Cell Phone Litigation
Injury or death caused by a driver by being on a cell phone is becoming more common as more and more drivers pack this potential lethal distraction. Without doubt, science has establish that drivers on cell phones react slower, observe less, and stray from their lanes more, than those with both hands on the wheel and both eyes on the roadway.
And, while there are no reliable statistics on how many crashes are caused by cell phone gabbing, in 1997 the New England Journal of Medicine reported that motorists who use cell phones are four times more likely to crash, and equated their use with drunk driving. In a three-year study of Oklahoma crash data, researchers linked cell phone use with a ninefold increase in fatalities.
A driver who causes a crash because he was talking on a cell phone often goes undetected because police fail to have the requisite investigatory techniques to determine if the driver was on the phone at the time of impact, because most people who cause a crash while talking on the phone do not volunteer that information.
Ms. DeDominicis has brought justice to victims of these very drivers; and makes cell-phone inquiries on every crash case that she prosecutes. Often, her discoveries that drivers were on the cell phone leads to a quick and more substantial settlement.
